Westport Law Firm Named as One of the "Dozen Who Made a Difference" in 2008
WESTPORT, CT, Jan. 27, 2009 – The Westport firm of Begos Horgan & Brown LLP was recently honored as one of the twelve firms or individuals who made a difference in the legal climate in Connecticut in 2008. This is the first year that the Connecticut Law Tribune has awarded its "Dozen Who Made a Difference" honors to attorneys across the state who "left their mark on a tumultuous year," according to the publication.
The firm of Begos Horgan & Brown was singled out for partner Christopher Brown's representation of a client in a groundbreaking decision about residential foreclosures. The decision last spring could make it more difficult for lenders to foreclose on mortgages. The Connecticut Superior Court ruled that the institution that began a foreclosure action against a Madison woman could not go forward because the institution could not establish that it owned the loan. "This was a significant ruling because it's the first time a Connecticut court has dismissed a foreclosure for this reason. It is likely that the same defect that was fatal to the lender in this case exists in many, many other mortgage foreclosure cases," says Atty. Brown. "Lenders have grown sloppy, suing first, and then trying to fix up the paperwork later. This ruling has significant implications for both lenders and borrowers in the foreclosure wave that has already started to crash in the courts." The publication cited the firm as "…Pioneers of a defense that has been tried, with mixed success in states such as Massachusetts, New York and California … [that could focus]…a more critical eye on lenders and their abilities to take away peoples' homes."
