Connecticut Supreme Court Cherry Picks Mortgage Foreclosure Case from Appellate Court

WESTPORT, CT, Feb. 16, 2011 – In a surprise move, the Connecticut Supreme Court has directed the Connecticut Appellate Court to transfer a mortgage foreclosure case to the Supreme Court for determination. The case which was originally filed by a note holder in New Haven Superior Court in 2008. The issues on appeal relate to who has the right to foreclosure a mortgage and whether a valid mortgage can be given to Mortgage Electronic Registration Systems, Inc. (MERS).

"The appeal raises serious questions about the propriety of the mortgage industry's foreclosure tactics. The transfer indicates to us that the Supreme Court recognizes urgency to its scrutiny of those tactics that should not be delayed by Appellate Court review," says Christopher Brown, attorney for the defendant borrower. No date has been set for the Supreme Court to hear the case but Brown is optimistic that it will be before the end of the May term.
